Cem Heris

Between 2015 and 2020, we worked with the Cerebra team and managing partner Fikret Sebilcioğlu on a challenging and complex arbitration (ICC case) in which the Heris Family was the plaintiff. The subject matter of the case was a dispute between the Heris Family, the seller, and a leading holding company in Turkey, the buyer, regarding the earn-out payments due after a share transfer.

The earn-out calculation and payments were complex under different accounting policies, including foreign currency reporting. Through numerous meetings with our lawyers, the Cerebra team understood every aspect of the dispute and analyzed all financial data in detail. As a result of their work, they identified numerous inconsistencies between the data and errors in the report of a globally recognized accounting and auditing firm. Fikret Sebilcioğlu presented his findings to the Arbitration Committee as an expert witness; he refuted many of the arguments presented by the defendant to the Arbitration Committee and played a critical role in concluding the case in our favor.

Cerebra’s technical expertise, analytical skills, expert witness expertise, professional approach, professional focus, effective communication, presentation skills and especially effective cooperation with our lawyers, who played one of the most critical roles in this long process, contributed greatly to our winning the arbitration case.
